Overview

OmniColor respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our service.

If you believe that content on OmniColor infringes your copyright, you may submit a DMCA takedown notice to our designated agent using the process described below.

Filing a DMCA Takedown Notice

To be effective under 17 U.S.C. § 512(c)(3), your DMCA takedown notice must include all of the following:

  1. Identification of the copyrighted work: A description of the copyrighted work you believe has been infringed. If multiple works are covered by a single notice, provide a representative list.
  2. Identification of the infringing material: The specific URL(s) on OmniColor where the allegedly infringing material is located, with enough detail for us to locate it.
  3. Your contact information: Your full legal name, mailing address, telephone number and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement under penalty of perjury: A statement that the information in your notice is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Signature: Your physical or electronic signature.

What Happens After You File

  1. Acknowledgment: We acknowledge receipt of valid DMCA notices within 2 business days.
  2. Review: We review the notice to ensure it meets the legal requirements of 17 U.S.C. § 512(c)(3).
  3. Action: If the notice is valid and we determine the content is infringing, we remove or disable access to the content, typically within 5 business days of acknowledgment.
  4. Notification: We notify the party who posted the content that it has been removed, and provide a copy of the notice.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may file a counter-notification under 17 U.S.C. § 512(g)(3). Your counter-notification must include:

  5. Signature: Your physical or electronic signature.

Send counter-notifications to dmca@omnicolor.pages.dev with "DMCA Counter-Notification" in the subject line.

What Happens After a Counter-Notification

  1. We forward the counter-notification to the original complainant.
  2. We inform the complainant that we will restore the removed content within 10–14 business days unless they notify us that they have filed a court action against the alleged infringer.
  3. If no court action is filed, we restore the content.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, OmniColor has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the site and/or terminate the access of any user who infringes any intellectual property rights of others.

Because OmniColor is a static tool website without user-generated content, we do not currently have user accounts. However, we reserve the right to block access from IPs or sources associated with repeated infringement.

What Does Not Require a DMCA Notice

Some cases do not require a DMCA notice and can be handled with a simple email:

  • Minor attribution issues: If we forgot to credit a source, email us and we will update promptly — no formal notice needed.
  • Broken links: If a link to your site is broken, email us.
  • Fair use disputes: If you believe content is not fair use, please explain the issue in an email. We are happy to discuss and may remove content to avoid disputes even when we believe fair use applies.

Misuse of DMCA

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. We take misuse of the DMCA seriously and may pursue legal action in cases of bad-faith notices.

Reporting Non-Copyright Issues

This DMCA policy covers copyright issues only. For other issues:

International Copyright

OmniColor operates internationally and respects copyright laws in all jurisdictions. While our DMCA policy follows US law, we will respond to valid copyright claims made under other jurisdictions' laws (such as the EU Copyright Directive) through the same process. Email dmca@omnicolor.pages.dev for international copyright claims.
